AITA?

Question

So I was rear ended at a red light by a teenager who was texting and driving (couldn’t be proved by the officer, so she wasn’t charged as such)
Anywho my car had significant damage, and with my insurance I still have a $500 deductible. I live in a no fault state, but can sue in small claims court for the deductible. 
I’m not made of money, and with how things are going I don’t really have extra cash to throw at things like this if I can avoid it. 
Am I a jerk for wanting to take her to small claims court to cover my deductible?

No, not at all, but court is a hassle and not free if you do not win court fees in the settlement. I am also in a no fault state. Many of the body shops near me will pay your deductible if you use their shop. Check around to see if any near you offer the same type of deal. May be less of a hassle than court.

Why isn’t your insurance company having her insurance pay for the deductible and waiving it for you? Step 1, I’d call the insurance company.

Nope, do it.  I regret not doing the same when I was slammed into a guide rail by a woman who blatantly told police “when I looked up from my phone it was too late.”🤦🏻‍♀️ I was 6 months pregnant in a car I just drove off the lot.  I had to pay $800 just to pay off the brand new car and go buy a new one.

How could he not prove it? Did he not look at the time the teen responded? The teen should’ve came forward and told the truth. Honestly you should’ve gotten their parents contact number and talk to them about the situation

Itll cost you more in small claims that it would to just pay the deductible.  Consider lowering your deductible through your insurance for future incidents if your current deductible isn’t doable.

I don’t think you’re an asshole, but you’re going to spend probably half of that taking her to small claims court AND if you don’t win the lawsuit, you’ll have to pay those fees plus the deductible.

Honestly if you're willing to go through the hassle and cost of court do it. Don't worry about morals at that point. Yes, it's a teenager but teenagers are old enough to pass a driving test and know texting and driving is not acceptable. They just think they are the exception and nothing will happen to them, some adults even. I don't agree with giving them a free pass just because "mistakes happen". If not taught a lesson now, they will do it again. Tough love.

Nope. Fuck them. I would take them for whatever you can get. Rental car if your company doesn’t cover it. Car seats if your insurance won’t pay for replacements.
