So I got this notice my rent is due every 1st n they give us until the 4th but I got rental assistance this one month and they sent the check to the office by mail on Friday n maybe tmro they should get it but one of the ladies in the office I spoke to said she got the email that confirmed the check is mailed already. This other guy in the office is the one who put this letter on my door. Does this mean I’m getting kicked out even if I pay by tmro? I’m in TX btw.. :( this is the first time this has ever happened it’s literally my second month being here I’ve never been late…

Speak with management. The problem is your 8 days late now.

Your notice to vacate is the first step in the eviction process.  They also don't have to give you the option to fix the violation (non payment).  If I were you I'd be in the management office first thing tomorrow morning to talk to them.  There's a chance that their systems are set up to automatically generate notices based on their accounts receivable and these 2 employees didn't communicate.

Yes honey, if cut off to pay is on the 4th then you're already 4 days past due. This is a notice for you to vacate the premises meaning you are being kicked out. I would like to note that this isn't an eviction notice so I'm not sure of the difference but this is a notice for you to leave.

It definitely looks that way. Did you tell the rental office about your situation with ample time (before rent was due)? If so, maybe they didn’t take that into account when handing these out. It sounds like you’ve already confirmed the check has been sent, I would stop by the rental office and talk to them as well as providing proof that it’s on its way.

I mean yeah they’re kicking you out for not paying on time. Is this the first time it’s happened? I’d call a lawyer for a free consultation, I live in Texas and we’ve been late once or twice by a couple days and they’ve never threatened eviction. I’d also talk to the lady in the office you spoke with about why it was placed on your door if she said you were ok.
