Lol over mobile phone use

My son's dad was deemed many years unsafe with my first born son because of dv on me in 2019. My son is now 5 years old. But having child protection services let go of us both, we now agree among ourselves and have just a parenting plan. I joined my son's dad just on a city trip to see the big windows for Christmas and to have lunch and ice cream on the past Sunday. On the way there, I noticed he mounted his phone on its stand but he constantly touched it for setting GPS and changing songs. He proceeded to explain he'd recently copped a fine of $545.00 for having his phone on his lap and he had no points left so he nominated the driver as his brother, which will need to be accepted. If they find it was my son's dad he loses his licence. (After copping one fine last year, for about the same thing touching his phone). My question is, I guess is it not my place to just tell him to grow up a bit as every Sunday he carries my son in the car or due to being divorced it is not up to me to be his mum and to tell him to lift his game. (Mind u I paid our house rent one day when we were married as he had gambled it away). We already had child protection on us so I don't want to start it up again. I want him to see his son, but come on being 37 I think he's adult enough to be safe with my boy after being deemed finally safe.
