Divorce

Might be a silly question but legally, my daughter isn’t my husband’s due to my ex boyfriend signing the birth certificate at her birth. But due to a DNA test (not court ordered) after she was born, I found that she is my husband’s. Currently fighting my ex in court to get him off her birth certificate and what not but nothing has really been done yet because I believe the state can’t find him. Anyhow, my husband and I are currently pregnant, baby is due in 4 weeks but being that he isn’t here yet and my husband hasn’t signed a birth certificate (not sure if he will or if I even want him to at this point), i have been thinking of filing for divorce. With the current circumstances, do I have to file that we have kids or can I not to make it go smoother/quicker? He’s already stated that with our divorce, he will not be involved in their (the children) lives at all & he has a son in another state in which whom he lost connection with due to not wanting to deal with his mother so I strongly believe he means it. Anyhow, I do plan to consult with lawyers to get a definite answer but I don’t have the means to actually pay for a divorce lawyer. Plus, my soon to be ex husband isn’t a US Citizen and I honestly don’t want anything from him but my life back so the divorce should go fine.. just curious about whether I have to say we have kiddos or not.. thanks in advance.
