Time off

I'm due in July… With FMLA I get 12 weeks off. I was hoping to take about nine during the school year but I just found out that they start counting the 12 weeks as soon as the baby is born… This is over summer vacation why would Summer count as time off when I'm already not working? 
Anyone else running into this problem? Is this normal?

According to the Labor department summer breaks and any other breaks the school is not open can not be counted as your 12 weeks. Your school district is violating your FMLA rights if they tell you other wise. I ran into this in 2014 with my daughter. The labor department volunteered to get involved but my school district changed their thoughts very fast. Now at my school you had to use your sick days first and then go with out pay. FMLA doesn't mean you get paid it just means they cannot fire you. You can call the labor department hotline and they are very helpful!

Summer break doesn’t count in OHIO or any break . FMLA is used on days we are suppose to work so when I had March baby I didn’t have to count spring break or summer break.

Our school can’t count it if they aren’t open. So I’m due in a week, was supposed to be on maternity leave now. Since the school isn’t technically open, they can’t charge me days or FMLA, even once baby is here until the school actually opens again. So I could, if I wanted, take all 12 weeks at the start of next year.

Yes this is normal because your contract is a full year. You can take additional time and use your sick days to be paid.

Our school lets us take a leave, but we only get paid if we are also on short term disability.  Otherwise we have to use out PTO/sick days.

My district is the same way! My friend had a baby last July 21 and she only got the first 8 days of school off bc we only get 6 weeks and it has to be the 6 weeks right after the baby is born... So unfair

My school district gives you 8 weeks paid from the time of birth... I can take 12 weeks under FMLA but the last four weeks would be unpaid.  I'm due in August... So depending on when baby comes, my first week or two of my 8 weeks could be summer vacation.  I'm not so thrilled about it either!

Wow! I will have enough sick days saved up to cover mine, so I don't have to worry about that. That is very frustrating though!

Yes you are very lucky. I got 8 weeks paid after my c section minus sub pay for the days after I used up my sick days.
