What would you do?

So my daughter is 7 and suffers with chest infections a lot plus also has asthma..

Her father & I are not together & haven't been since I was 4 months pregnant on her..He is a heavy weed smoker & also lives with his parents who smoke cigarettes too..

Here's my problem: For 7 years I've been asking him time & time again to not smoke around her & he insisted he always goes outside to smoke that it's his parents who smoke inside & when I asked him to ask them to stop when my child is there his mom said no because she did it around her kids & it "did them no harm"..So I kicked up blue murder insisting he do something because DD was sick every second week..Eventually I get told that they don't smoke inside no more & even that her father has stopped smoking weed..

Fast forward to now.. I discover they still smoke around her.. I'm fuming because once again she is sick & missing school..I haven't confronted him yet..

My DH & Mom think I should stop her going there & let him take me to court and tell the judge I have health concerns..What would you do??

Do not allow her to go there any longer and take him to court. They are not putting your daughters health first. They are endangering her. She has asthma and other respiratory Issues and they are putting her in harms way. She should not be allowed to go there at all.

Stop taking her there allow him to spend time with her somewhere else 
They can't play with her health like that

If you take it to court you'll need to be able to prove medically that she is ill only after being around him and that smoking is the cause. Judges and sheriffs LOVE paperwork so if you've got that you're sure to win!  Also if you do take it to court the contact can be stopped until a new agreement is made so she won't have to go in the meantime.

Hi. I'm so sorry you are going through this. Your daughter comes first and her well being is what matters. She's just an innocent child and you have to protect her at all cost. My advise to you is to not let her go there anymore if they can't respect your wishes and the child health. Also get the court involved. I wish you all the best

Do you have a custody arrangement? If so, go to court first, and tell them why you want to restrict his access to her.  If you violate your custody arrangement first, then you're the one that's in the wrong.

She doesn't need to go there around all that. Honestly I think it's negligent when he knows damn well she has asthma. I think court is the answer here.
