Maternity leave/FMLA pay question?

So my husband and I looked and found out that we could afford for me to be a stay at home mom to our baby boy die in June. I'm getting 6 weeks maternity leave with FMLA and he doesn't want me to tell them I'm not coming back until 2 weeks before I'm supposed to return to work. He is scared that they won't pay me my FMLA/maternity leave pay if I tell them I'm not coming back before I have our son. Does anyone have any experience with this? We just want to make sure I get the money I've been paying out for short term disability and FMLA. Thanks!

I definitely wouldn't tell them beforehand. That's basically quitting so I don't think they'd be required to pay you. Some places will make you leave on the spot if you tell them your quitting.

FLMA isn't paid.. It's a federal program So actually your just getting paid that short term disability pay. Which they aren't required to pay. So I would put your two weeks in before you are supposed to come back .. Even though that's kinda shady it is probably your best option.

Check company policy. I know with my job if I don't come back to work they can take pay away and charge me back any benefits they paid while out on FMLA.

You could always go back and give a two weeks notice your first day back. The. You just pay back health insurance premiums but no other penalty.

It depends on your company and your state. I'm in CA and I could leave without prior notice and not tell them until the last day of my leave. I would not tell in advance in my situation.

I wouldn't tell beforehand. But be prepared to pay back benefits that they may have paid on your behalf while you're out.

For example, my employer pays my portion of health insurance while
On leave. Once I return to work I set up a repayment schedule to pay back my portion of benefits and it comes right out of my paycheck.

At my job if you do not return to work after maternity leave you have to pay them back for the leave ( which is just saved vacation days) and the cost they paid for health insurance during your leave. I would try to read up on it a little more. I live in NC which does not require any paid leave, FMLA or not.
