If someone has a metal disability and rapes someone, should they still go to prison?

I'm not naming specific diseases because I don't want to hurt any more feelings. Let's just say a disability that makes someone not completely understand what they're doing if at all.

Should they still be punished with time?

If not what should happen to them to protect others?

This should be a case-by-case basis. At my work, one of our group homes is all men with disabilities who have been convicted of some type of sexual crime. I don't have any clients at that home for my own safety. I do not think prison would be safe for any of them. I also don't think it would be helpful in any way

They need to be able to get the treatment they need, and I also think it's important to determine whether or not assaulting people is due to their disability.

Next time I would include a trigger warning because this topic is very sensitive, but to answer your question... It depends on how functional they are and whether they know right from wrong. There are mentally disabled people that are fully functional people and know exactly what they're doing. My aunt's husband is mentally disabled, but he's fully functional, knows right from wrong, goes to work, etc. There's also some mentally disabled people who don't know right from wrong and don't know what they're doing. The ones who know right from wrong absolutely deserve prison time. The ones that don't should be incarcerated either in a mental hospital or something. They don't get to get off scott free just because they have a disability. That's not an excuse.

I actually kind of had a situation like this in 5th grade lol

we had a mentally disabled student. I had gotten a pass to go to the bathroom and when I was walking back to class, there he was. He had somehow gotten away from his aid and was just wandering around by himself. So I was asking him if he was lost, or needed help. And he just stared at me. So I tried to walk around him and leave and he grabbed me and held me down against the wall trying to makeout with me. And I was obviously saying stop and get off me. I had bruises afterwards from him grabbing me so hard. Eventually I got out of his grip and just fucking ran full speed back to class. It was really scary - but I never really blamed him for it? Like, I don't think he really knew what he was doing. I don't think he knew that you can't just grab girls and kiss them, and that if they say "no" then you need to stop. So I ended up never telling anyone because I didn't want him to get in trouble. I probably should have - looking back. I just didn't want him to get punished for something he very likely didn't understand.

I don't think punishment would be very affective if they do the understand what they did wrong.

But if he is considered a harm to either himself or others, he or she would need mental health therapy.
