Is this considered rape?

My ex boyfriend and I were dating at the time and we were both in bed. I was trying to go to sleep while he was on his phone. As soon as I’m right on the verge of being asleep, he grabs me and puts his finger up my butthole. He knows I don’t like this but he started laughing and every time I moved or tried to push him away he’d push his finger in further. We eventually broke up but continued having sex and this was pretty recent. We were having sex and he again puts his finger in my butthole. I asked him to stop because it was hurting and he said no it doesn’t and kept pushing in it. Is this considered rape or sexual assault?
