How to get custody of my little sister?

She's my step sister. She absolutely hates her mom because she's cheating on our dad non stop. She hits on her and choked her in Walmart. I know that they won't willingly sign over rights because well I'd have to tell our dad and I did once before, years ago, and even then I don't think they would. How do I get her? She's cutting, smoking pot, trying to have sex with 18 year olds and she's 13. My dad knows nothing of it because his wife hides everything from him.

Report it to CPS, WITH proof of her mom’s neglect. Then request to them that you would like her to be placed in your care, and make sure you alone are stable enough to be able to care for her, because they will look in to you to be sure you are capable.

I don’t fully understand the situation. You said you told your dad once before. But then you’re saying she hides everything from him. He didn’t do anything when you told him? And he doesn’t know what his daughter is doing? He lives with them? You need to report it to CPS first. Then they will make the decision to remove her from the home or not. There’s no guarantee you will get custody of her though.

Your chances of getting custody are almost nonexistent. 
First, you HAVE to tell your father. But make sure you go to him with proof. 
Second, the ONLY thing you can do is call CPS (again, with proof), and request that IF they remove her from the home (VERY slim chance of that happening), that they place her with you. 
I’m sorry you have to watch this, but unfortunately, there is NOT a lot you can do. And the only way you can get custody (especially since you’re not even blood related), is for them to hand it over to you. Good luck.

Others have given great advice about going to CPS and / or telling your dad. I also suggest taking her every chance you get to spend time with her and give her something to look forward to and someone to look up to. Talk to her about everything going on and try to help her until you can get her full-time.

It’s called kinship placement if she’s placed with family (aka you). We got custody of our nephews because my sister in law thought it would be a very short term placement. There’s no guarantee she will be placed with you unless her legal guardians ask her to be placed with you.
