Can your baby be taken away if you test positive for THC? 🤔

My SIL is 32 weeks pregnant and through out her whole pregnancy she has been smoking weed, before she found out she was pregnant she was smoking cigarettes & popping pills but after she just quit and is still currently smoking weed..so my question is since she's due in Early December, when they take blood at the hospital and she comes off positive, will they take the baby away? She's also only 18 my brother is 21

Does her doctor know she smokes? I’ve heard if they are aware they will likely test at birth. If they don’t they might not test at all. 🤷🏻‍♀️

from my personal experience i wasn't allowed to have my son in my care by myself. i was to be monitored at all times and had to take drugs classes and parenting classes and everything. more than likely she'll have to do the same.

Well since her doctor knows about it and you’re in a state it is legal in I would say it is fine.

There really shouldn’t be any drug/smoking or pill use during any pregnancy or ttc...I wouldn’t be surprised if they get cos involved...and believe me, she doesn’t want that...CPS doesn’t play around

Here in Oregon, we’ve been told by our hospital and social workers that they won’t do anything about it. It has to be reported if the baby tests positive. But they also know that it can be in their system even if mom stopped back at 20 weeks. So it’s a case by case deal. If mom tests negative at birth but baby’s first poop tests positive they just do a report and leave it at that. At least that’s what we have been told. But everywhere is different.

I work for CPS in Georgia. Here they automatically screen babies at birth and by law it has to be reported to CPS. We generally dont take kids just for marijuana. We generally will do repeat drug screens on mom, have mom identify family supports, MAYBE a full substance abuse assessment, but that's generally if we find out there is more going on with the family. The whole investigation is more of an inconvenience than anything.

The closer she is to her due date and they test her positive , yes there’s a possibility when the baby comes they will get cps involved . Everywhere is different but that’s how they do it where I’m from. U get a warning the first time u test positive but if it’s near ur due date and when ur so far along failing drug tests they get cps involved .
