I got served child support papers when I have primary custody!

My child’s father went and got food stamps and put our child on his application over the summer apparently and he lied and said he had custody and I don’t pay child support. I have primary custody of our daughter and he gets her every other weekend. Well he did until he got arrested two months ago for absconding probation and felony obtaining property by false pretenses. Now, the state is coming after me for child support!! I was served papers today! I know I can get it taken care of by providing my custody order to them once the worker calls me back or prove it in court. It just angers me because this shouldn’t happen in the first place! Apparently he also told them she doesn’t have health insurance because they are requesting I provide that. And that’s a lie too! SHE HAS INSURANCE! She has Tricare through my husband who is active duty! Hell, I don’t even ask her dad to pay child support at all because I know I won’t get it if I did and he’d end up in jail for non payment too and that certainly wouldnt have done our daughter any good even though he ended up there anyway. I even pay for him to be able to call my daughter EVERYDAY while he’s incarcerated so they can maintain their relationship!! And those calls add up!! Just so fed up and needed to get that off of my chest!

After emailing all of my documentation and proving that I have my daughter per a court order and that she is covered by my husbands tricare, the worker notified me today that they are requesting a dismissal of the case and it will be closed. At this time I do not know if the state will be going after my ex for fraudulently receiving government assistance or not, and I’m considering filing papers for him to pay child support.
