She should have sued for valid reasons (i.e. She was not given what she payed for in her contract with the company ect.) not because having a black child inconveniences her. Poor little girl is going to grow up thinking she's just an inconvenience now 😟

Seems fairly cut and dried to me.

She has a legitimate case. However, the way she went about it makes me worry a bit for the little girl.

I agree she paid for a service and she should be provided with the product she paid for. For what ever reason she stated for her law suit ( wether I agree or not ) she should of got some kind of settlement. The buisness was negligent. This spermicide bank is a buisness and needs to be held responsible.

Absolutely correct, wrongful birth doesn't apply to this situation at all. The baby is healthy, and wrongful birth suits apply when parents accuse doctors of failing to discuss risks or test properly, and a child is born with a congenital disease.

I do think she should receive more of a compensation than just a refund, and the clinic should face some sort of punishment. Mixing up medical samples / body fluids is a huuuuuge no no. I'm glad she loves her beautiful daughter though.

I think that if her concern is that she has stereotypes about black people and limited cultural competency that the clinic should pay for cultural sensitivity training. Imo that's all the lady deserves in this case and it would be a fair resolution.

I remember reading about this last year when she first sued. While I understood where she was coming from, I felt so bad for the little girl. I worry that she will grow up hating herself because she will feel that her moms didn't want her. In the original story, the woman said that she lived in a racist town. What if the little girl is bullied for being mixed race? It's a very sad story. Hopefully the moms can get some culture training and move to a diverse area and learn to love their daughter for who she is inside and out.
