Should people who record and post assaults be punished? (TW graphic image)

So I’m sure we have all seen the viral video of this man on a subway kicking a 78 year old woman multiple times in the face

In the video there are 3 camera and people recording. The one the video came from, another from someone who was closer to the attack and another one at the end of the video.
According to the (court of public opinion at least on IG) the general “verdict” is the people recording should receive punishment as well. Which brings me to the  topic question, should people who record a violent attack or assault ( be it kicking like this, rape, etc) and choose to post it instead of notify police, should they receive jail time or a form of punishment as well. 
Or would that be like a “Good Samaritan” law ( like on Seinfeld)

Ok so I can see different sides. Yes everyone who is physically able should intervene, no doubt. BUT that’s not always possible. For example, I always have my baby with me, I’d fucking scream at people to do something but I couldn’t get in the middle because my baby’s safety is my first priority. Now filming it to give it to the police could actually help identify and prosecute the assailant. I don’t agree with posting it on social media whatsoever tho and think there should be charges for that.

They shouldn’t be charged with the SAME crime.. but something, yes. I don’t expect everyday citizens to intervene in crimes like this because he’s obviously got problems and someone could get themselves killed intervening.. but taping it for amusement or to gain your own fame is ridiculous

No. You cant and shouldnt expect untrained citizens to intervene and endanger their lives. You arent, and shouldnt be, obligated to risk your safety for others.

No one is required to intervene and put themselves at risk but if they dont call police then something like a fine or minor charges, not prison. Is it a crime not to report a crime, like failure to report a car accident?

I haven't watched this because I don't need to hate humanity any more than I already do, but if you ignore someone being assaulted and instead choose to stand around filming and THEN post it on social media, yeah, you should be punished. I think a year of good hard community service would do idiots like this some good. This is disgraceful.

I’m on the fence here. On one hand, if they were just a bystander and not recording it, would I believe they still should be punished? Not really. 
On the other hand, they were recording without the persons consent and posted it online, I believe that’s punishable in itself.

I said community service. I don’t expect people to intervene, but posting the video is quite disgusting, I think. At my old school, a fight broke out and one of my friends recorded it and posted it on her social media. She was criminally charged and sentenced to community service. I agree with the sentence.

They don’t have to step in and fight the guy, but they should all band together and try and stop him from hitting and harming her or at least alerting someone that can help. Maybe even stop the train or whatever. By all means they should definitely not be recording. They should get some kind of punishment for filming it.
