Is This Right?

It starts off as a friendship between girl and guy. Girl and her husband decide to start polyamory. Husband goes and starts dating, girl doesn't care. Husband sets up guy and girl. 
Husband becomes more and more abusive, girl leaves and develops relationship with guy. Girl is forced back to abusive husband and breaks off relationship with guy. Husband rapes girl. She reports him. Girl and guy get back together. 
Girl starts process of divorce and family tries to keep her away from guy. 
The question is, does their relationship count as adultery if it started as polyamory and the ex husband set them up?

Legally I’m not sure. But I don’t think it should be considered adultery - if you’re in this situation I’d try and gather all the evidence you can that he set the two of you up and he started dating first.

Unless there's proof like text messages, or social media DMs then if one party is denying being ok with the open marriage then I believe it becomes hear say. 
Morally I don't think it's wrong, but if you are in one of the 21 states that adultery is illegal then I think it can go either way.

If they can both provide they consented to an open marriage.. then adultery would be a moot point to the rest of the case.. but if one got one to lie  to make one look wrong then it might be an issue.   
But the rape and abuse doesn't seem like something a juror or judge would/could ignore just because of an open marriage or even adultery..even if a partner cheats it doesn't make it right for the other party to abuse and rape them.
