Parking / property management issues

Emily

I’d love advice and opinions:

I live in a 7 unit building in downtown. My unit is in the front of the building against the street and it appears to be a townhome. There is a parking lot in the back of the building with a total of 7 assigned parking spots — one per unit.

My fiancé and I usually opt to park on the street in front of our house so we can see our cars when street parking is available. Sometimes events down town take parking so we rely on the our assigned parking spot in the back.

Most of the parking spots are against the building where there is a sign that says “tenant parking only” with tow info and city codes. Unfortunately, our parking spot is behind these other spots so there is no sign directly in front of our spot. However, the parking spot is still outlined and has our unit number on it.

Back story: 2 months ago, I got home at 9 at night and there was a concert nearby and the street was full. When I went to the back lot, a car I’ve never seen before was in my spot. There wasn’t a parking spot in walking distance, it was dark, and I had groceries. I tried to call the number on the sign on it building and the call directed me to our local police department (non emergency). They told me the sign must be old because they cannot help if it is private property.

I called our emergency line for property management and reached Susan who is in charge of maintenance. I calmly explained to her that someone was in my parking spot, there is an event downtown and there is no where for me to park. She wrote me off and said, “well we usually just leave a note. You can call [this] tow company. I tried that and he tow company refused to help me and said that the owner or property management would need to call it in. I called Susan back and left a message. She finally got back to me and called in the tow, but said usually property management goes to the property to sign, but she wouldn’t so if I want it towed, I’d need to wait for the company and sign myself.

The tow company gave me a 90 min window and wouldn’t agree to a call before arrival so I stayed outside the whole time. Eventually the car was towed. A few days later the person’s kids came to my door, demanding to speak with me and was given my personal info by the tow company. My fiancé took care of them. The tow company gave my info and shouldn’t have but they wouldn’t have had it in the first place if property management did there job.

Tonight, a parade of lights was going on and someone was in my spot again — anther car I’ve never seen and traffic and parking was even worse! I called the same lady, Susan, and I was polite about it. She told me she would need to call her office supervisor. I didn’t hear back for an hour. When she called back, she informed me that the supervisor wouldn’t authorize the tow. I asked what I’m supposed to do and told her that they are quick to take my rent but not quick to assist with property issues. She said they normally are but kept repeating that the supervisor said no. I asked to speak to the supervisor and she said I can go in office tomorrow. That doesn’t help me now though.

By this time, I explained to her that the parade seems to be over and traffic gone, but I still don’t have a spot and asked if she would come down and go unit to unit as that’s not something I’m comfortable with. She said she understand but the supervisor said no to the tow.

I told her that the rental agreement includes a parking space and asked her if she had a parking space at her house. This is my home and I can’t park. I asked if I parked nearby and got towed if they’d pay for it. She also kept telling me to call a tow company. I said, “you and I have been through this together. You know they will not help me because I’m not an owner or property manager.”

She told me that she’s in the hospital with her son and she isn’t going to talk to me about parking. I asked again what I should do. She hung up on me.

It’s not that I’m insensitive to her being in the hospital with her son, I just feel that she shouldn’t be the one taking calls if that’s the case. Her supervisor is the one with the bad news and in the industry I work in, a supervisor would’ve talked to me. We pay more to live in downtown, not less. I live in California (FYI for those who look at this in a legal perspective). I am going to post a picture of my rental paragraph that says the one space is included in my rent.

I plan on going into the office tomorrow. What would you all do?

PS I KNOW this is petty and I’m dramatic. I’m 9 weeks pregnant and don’t feel good. I also give customers my best service and I expect the same. I know they’re not the ones parking in my spot, but my hands are literally tied and it feels like property management does not care.
