Can they do this?

I sell merchandise at a outdoor market that’s open 1 day a week. I pay monthly for my spots to sell. ($450 a month) I don’t have storage there so I have to bring all my merchandise every week to setup. Do to coronavirus they are closed so last month I only got half of the month even though I payed my full months rent. I called in today and they told me I have to keep paying rent every month even though they are closed or I will lose my spots to sell, and they will not reimburse my money. So now they are telling me I owe them $450 for this months rent even though they are closed and I can’t even step foot on property. So if I pay they then that will be $675 for services they are not providing me and I won’t get a refund or credit for when they do open back up. I told them this is not fair to make me pay for services they are not providing and I have no income because they are closed. Can they do this?

Yes, you’re reserving or renting a space.  Whether or not it is open is really irrelevant to the contract.

I’m pretty certain they can. I know in my town there are plenty of small local businesses that still have to pay rent on their commercial space.

I think thats really terrible that they are still charging you. I know a previous poster compared it to daycares who are still charging parents. My premier ordered all daycare to cease charging parents when they are closed. This is not business as usual and I think that it is unethical to be charging ppl for services not rendered in a time when ppl are losing their jobs, having their salaries cut, dying, etc.
Have you talked to other vendors? I'm sure they are feeling the same. Maybe you can work together to talk some sense in the owner.

It depends if you have a contract with them or not. If you have a contract that states you must continue paying to maintain your spot whether or not they are open (bad weather days, other events, etc.) then you owe the money. If they simply told you they chose to have a policy of continued payment to keep your spot reserved then you can chose to keep it or not.

Ya they can because it’s money holding your spot. If you don’t want to or can’t pay they give the spot to someone else assuming the virus will eventually end
