Should pregnancy delay a divorce?

pregnancy delay a divorce?" /> I was having a random coversation at lunch and learned that in Texas judges won't generally grant divorces, if the wife is pregnant, until after the baby is born. This is true, even if the husband is allegedly not the father. 
   
The minimum mandatory waiting period in Texas after filing for divorce is already 2 months without a pregnancy. Texas divorce petitions ask if the wife is pregnant. If she is, the judge will almost always wait until after the birth to grant the divorce.
   
What do you think about this and/or of mandatory waiting periods at all?

I think that when your pregnant your hormones are allover the place and it puts alot of pressure on your relationship so I can see why judges might want to delay things. I think unless it's a case of abuse or adultery then maybe it's best to wait till after the baby is corn to see if either of you feel different.

I'm glad pennsylvania doesn't have that stupid ass law.

My ex husband wouldn't give me divorce. I got pregnant with my boyfriends child. In PA if you're legally married the "husband" is the father. The end. It's called assumed paternity. Thankfully my lawyer found loopholes and pushed my divorce through so that my boyfriend could be our daughter's legal father on all paperwork.

Pregnancy does not make you insane, it doesn't make you incompetent. You can file all you want but there's always a wait and various forms to sign to approve so if you were not sure then even pregnant you  would have to be sure multiple times not just one hormonal day.

They have to hear the details during the divorce anyway. I don't think pregnancy should stall the proceedings because everyone's situation is different. My state is the same way and I personally went through that.

No because there's the possibility of making the baby be born into a bad marriage where there is no love and I wouldn't want a child raised around that. That's not fair to a child to have to live with that.

That rule is in place so that child custody and support can be ruled on within the divorce proceedings and the child needs to be born for that to occur. However in the case of the child not being the husband's there is a way around the rule I know because I know someone who was getting divorced from her husband and ended up pregnant during the divorce. The judge tried to make them wait but the husband didn't want to pay insurance on someone else's baby growing in her and she was unemployed so no insurance but didn't qualify for medicaid because being legally married still they went off the husband's income. So the judge ordered a dna test to be done on the baby inutero which I would not recommend doing as it is highly dangerous. Of course the dna test proved the husband not the father and the divorce was allowed to proceed and finish before the baby was born.

I think that's just sad. Like a won an won't know what she wants because she's pregnant. It has nothing to do with the child and having two parents around, because they grant a divorce after birth.

I live in Ireland & when my parents decided to divorce they had to be legally separated 7 years before being granted the divorce so when they finally got it they had been apart over ten years

In Louisiana, if there are no minor children, you have to be legally separated 6 months, and if ther are minor children you have to be legally separated 12 months, before divorce is final. And by legally separated, I mean from the date the divorce is filed. So you can be separated 6 months, and then file, and still have to wait another 6 months before its final.

He'll in VA you have to be separated for a year with no children and 2 years of you have children before you can file... 2 months or 9 is better than that.
