Adoption with no name on BC Questions!!!!
So i have spoken to 2 lawyers today and the court house here locally. I am calling a 3rd tomorrow since I'm confused.
My son is 10 (almost 11) i married his dad (not biological) about a year ago and we met back in early 2012. We decided right before the wedding if our son wanted him to be dad (call him dad be his dad) my hub would formally adopt. Well lil man has said yes to that and we are.and have been looking into adoption. Wedding, finding out we are pregnant, moving, etc has now calmed and we are back to working on the adoption.
First i called the court house downtown to find out what we need and was told even though the BC is blank we still have to get the bio dads permission and would beed a lawyer and court date. That if we just put him on the BC it would be fraud.
Now the spermdonor didnt meet our son till he was 5yrs old, has seen him no more then 6 times, never bought a damn thing for him AND hasnt seen him since he was 5.......
Lawyer #1 said just to go downtownand put my husband on the BC that it is NOT fraud since the sperm donor has made.no claims to rights, we never took put child support and as far as the system knows the dad is unknown.
Lawyer #2 said.no it wouldn't be fraud but the sperm donor could come up later and cause trouble so it's better if he signs over any rights known or unknown and we go to court to cement everything. Then quoted me $9000 for getting everything done i could pay my car off with that money.
We are in SC and i was wondering if anyone has had something similar happen. Or has advice.
