Is this considered theft? UPDATE 1

So my fiancé recently invited two people to come stay with us so he can help them get a job get on their feet etc. one of them he was good friends with his name is Bryce. Well Bryce brought along his friend when we picked them up his name is Ross. They were here maybe a week before bryces mom came and picked them both up. Well apparently Bryce and Ross are both drug users my fiancé used to be a user too so I’m guessing it’s meth at least that’s what my fiancé did. Anyways while they were here my fiancé let Bryce use my old iPhone 5s to get on Facebook talk to his daughters whatever whatever. The deal was he could use it while he’s here and when he gets a job he could buy it from us he said he would give us money for it. Quick side note maybe a month or two prior to them even coming to our house my fiancé said his coworker wanted to buy the old iPhone off us so I reset everything on it. Well that plan fell through and we never put our Apple ID back on it. Big mistake 🙄. When they left Bryce said he put the iPhone down in the living room and that Ross must’ve thought that my fiancé gave it to Bryce. So apparently Ross grabbed it and they left. Well now it’s been maybe 2 weeks and my fiancé asked Bryce if he had the iPhone because I was looking for it. He said “no Ross must’ve grabbed it I’ll still pay you for it if he took it”. I was like okay cool at least he’s taking responsibility for HIS friends actions. (My fiancé didn’t hardly know Ross too well so it was more so bryces friend). Last thing he said was I’ll give you money for it and that’s that. Now he’s been leaving my fiancé’s messages on seen. Can we still report the phone as stolen? I mean cops always say oh but did you see them take it? No we didn’t. All we have is that Bryce admitted Ross had the phone. Or it was all a lie and Bryce really has the phone either way one of them has it. And I just so happened to have the imei and serial number basically all the phones info saved. How do I go about reporting it? Are they able to go to Bryce or Ross directly and look for it since one of them admitted to having it? Or is there nothing they can do since I can’t track it anymore.

This is him saying that Ross grabbed it and he’d still pay us $80. They’re both drug users who don’t have a place to stay regularly they couch surf at everyone’s house but I have both of their names it’s just we don’t have an address to connect them to. As of now Bryce’s mother said she would pay us for the iPhone since her son is back on drugs and running around. He’s over 18 which is what is shitty because his mom shouldn’t have to pay for his mistakes but we really need the money right now so I guess this will do 🤷🏽‍♀️. She looked after my fiancé like her own son when they had ran away from a shelter to her house. So he calls her mom and he feels bad that she’s giving us money for something her son stole.
