How does custody work if the dad moved out of state ?

I have a three year old daughter and her father moved to Oregon about a year ago and I live in California and it’s also the only state she has ever lived in , her birth state . We have been doing I get 3 weeks and he gets one . The driving has gotten to be too much considering I work full time and am starting school . Her daycare , doctor, and dance classes are down here and I would like to file for full custody but I’m scared to loose and get her less . We were never married he only sends me 200 a month and as you can imagine it doesn’t cover even a week of her daycare . Anyone have experience with this ??

I think this should work in your favor. He is the one who moved away. My husbands ex moved out of state, she has full custody, at the time she moved he had no funds for a lawyer and was too depressed to do any fighting. If I’m not mistaken, the one who moves loses and if it wasn’t agreed upon, you can automatically get full custody, just a little of what I know

I highly doubt they’ll give you full custody just because he moved especially when he sees her and gives you money. Even if you think $200 isn’t enough, child support is income based anyway so his income will decide that if you end up getting child support through court. My dad moved out of state and still helped my mom. They have joint custody and he gives her his allotted amount of child support.

Yep... Just got done with this with my ex husband. We have 50/50. No child support because hes a bitch. He moved to southern Utah and if they move over 300 miles away they need to give you and the court at least 30 days notice. You can take him for full custody but if he is a good dad and wants to be there the judge will usually want the child to see both parents, in that case you can ask that he makes the trip to pick up and drop off since he is the one who moved out of state. And you can ask them to reevaluate the child support.
