As someone who was sexually assaulted I absolutely think they should be charged. Not only do they waste the police’s time but they also make those who are genuinely assaulted be second guessed by the police. Which results in men and women not want to come forward about being assaulted because they may not get believed.

So tired of people asking this question about only rape/sexual assault. If anyone commits perjury then they should be charged for it. In my state, if the lie is told outside of legal proceedings, it is a first degree misdemeanor. For perjury occurring during a legal proceeding, it can be up to a third degree felony.

I want to say absolutely they should. 
But on the other hand I can see how awful this could possibly be. 
What if someone who was actually telling the truth, ended up getting charged for "falsely accusing" someone, because the rapist/abuser had more power and was able to throw it all under the rug, similar to how they do now? 
It would absolutely terrify anyone into coming forward. I can see so many ways it could end badly. 
If we lived in a world where that couldn't happen. Then 1000% yes.

I would say yes, how do you know for sure that they lied? 
Because the rapist said it didn’t happen? Because there’s no “evidence”? Because the individual recanted and said it never happened? All of these can occur and the person can still have been raped.

I am a rape victim. And i would lie tomorrow if i had to tell the truth to the police if i have been raped. Why? Because its MY truth and if i decide to live with that truth until the day that I died than how i tell myself fuck it. Im not ever going to tell someone of authority about my rape experience. At the moment im not ready to speak upon it. Im not ready to face the facts and face reality. Im not ready to cause my mother pain and im not ready to cause my father pain. I would lie tomo and no i don't believe i should be charged for it. Because its my truth, my experience, my case, and my sanity on the line.

Statistically people don't typically lie. It is VERY typical for a survivor to recant or maybe not remember details in full or in order.
There needs to be very clear proof they lied. We need to support victims and START BY BELIEVING.

If you knowingly falsely accuse someone of rape  I think you should absolutely be charged and it would be great if you got the same penalty as the crime you falsely accused the person for. Your life should be just as ruined as the person you falsely accused.

I think this is asking if someone’s been raped and then the cops ask and they say no, should they be charged? 
Maybe it means the opposite though?
I think you shouldn’t feel forced into coming forward, but if you say you were raped when you weren’t then yes you should be charged.
