Anyone from Texas???

Can someone please explain to me the laws on how things go when you’re in a car accident? I’m not from the state of Tx and this is my first accident here. I was rear ended yesterday and the police officers told me that they are not writing a report or ticket because my car wasn’t that damaged and the girl hit me admitted to it. I went back and forward with them because I’ve never heard anything like that. They let the girl go who hit me and she didn’t get a ticket, basically saying our insurances would handle it. When i got back in to start my car it didn’t start because somehow my belt popped off. I called my mom who doesn’t live here and she went off on them, after they talked to her they finally wrote a report up. I’m so mind blown how the situation was handled because they act like they didn’t care and I had my babies in my car. They had to tow my car away while we sat in the fire station, mind you my kids are 2 and 3. Maybe the laws are different from where im from🤷🏾‍♀️

I’ve been in multiple car accidents and fender benders ( in my 15 years of driving - in WA not TX)  and that seems pretty standard for a small accident. Why was your car towed? It still looked drivable? Your insurance should be handling the situation. The police probably filed a report but they don’t have to issue any tickets. 
Honestly, here, accidents with minimal damage the police aren’t even called (at least in my case). Just exchange insurance information and take pictures but it depends on who is involved and what the preference is.
The accidents I have been involved in that the police were called required their involvement. Like we got t-boned and the guy drove off. Turns out he stole the car and then hit us. But my car was still drivable so we just filed a claim with our insurance after the police filed their report. Another time a driver crossed the center line and hit me head on- turns out she was drunk and taken to jail.  My car was not drivable after that one. Are you sure they didn’t file a report?

They don’t have to write a ticket if insurance has been contacted, no. I’m in NC and have never gotten in a ticket for a minor fender bender

Get the call number. Even if they don't write an accident report the call number will have that the police responded to the call. Also pictures pictures pictures.

Those cops knew her somehow and are doing some shady shit. I'm not familiar with Texas law but there's no way they would normally let anyone just leave when your car is damaged

I got rear ended in April. Not on Texas either. The guy got a ticket for following too closely and I waited for the state police to show up. Traffic was all honking but I didn’t care. He got out yelling at me. I took a pick of his plate in case he ran and the damage to his and my car. I had gotten off An exit ramp and there was a red light at the end  so I stopped. According to him I backed up into him. I said you have to be kidding me who backs up at a traffic light. Cop said I know. But I have to take what everyone said. Glad you finally got a report. Most insurance companies won’t do much without a report. Depending on your state if it’s a no fault state. They make the payments go through your own company and then get it from the other side depending who was at fault. Rear end is usually the one who hits from the back. Good luck. Hope you are ok.
