Taking him out of public school

My kids go to two different schools. My 16 year old daughter goes to a private school because she got a scholarship to one. She was one of the 6 students that got it. My son who's about to be 16 goes to the public school. I've had a few issues with this school and it's never been the teachers. It's always been the admin. I was called into the school today to come get my son because some kids decided to bully him in the shower room and write pussy on his back while recording it. I was at that school so fast that his hair was still wet from the shower. Those boys have been suspended. They told me if I want to pursue any type of charges thats fine but i need to handle it outside of school. They also told me they are unable to get the video deleted because the parents wouldn't make the kid who recorded it hand over his phone. I'm not a lawyer but anyone familiar with the law tell me because I feel like if it's basically child porn then the parents can't refuse. So was the school right or were they bullshitting me? They didn't even call the cops. They sent the boys home before calling me. I have decided I'm most likely gonna pull him out of that school but he doesn't want to homeschool or even talk about what happened at school. I can't afford to send him to my daughter's private school and my husband says if they both can't go then we should pull my daughter and make her go to school with her brother so they can look out for each other. That seems so cruel since she tried so hard to get in. And she didn't like the sound of that either. The only other school is out of district. My husband says those kids were boys being stupid and that since they got in trouble they probably won't do it again and we should just write my son a note saying he doesn't have to shower after gym. Maybe that would be a good compromise since he doesn't want to be homeschooled?

Edit: I want to pull him out of this school because he will have to see those kids again. I personally think it caused for expulsion. Not suspension. If a kid can get expelled and arrested for setting off a smoke bomb in the hallway which happened at this school, why can't they expell and call the cops on these boys. Maybe the school couldn't make him hand over his phone but had they called the police they could have. The gym teacher caught them which is how he knew they were recording.
