Should someone who loses their memory still be found guilty of the crime they committed?

If someone commits a crime, let's say murder, but during the trial, or before they're convicted, they have an accident and lose their memory completely. Should they still be found guilty? Idk why but the other day while showering this all of a sudden popped in my head and I've been wondering ever since.

Yes , not only to give the victims family closure, but to me if I found someone committed murder and got off with it because of memory loss, that could send a message to other murderers that they can easily walk free if they do the same. Justice is supposed to be served to punish and deter others from doing the same, if they weren't taken to trial it sends a clear message to others in my opinion.

I don't think you should convict someone just to make other people feel better. If they had completely lost their memory they'd pretty much be an entirely different person and convicting them to me would be like convicting the wrong person. They should probably be forced to do at least community service or something like that and put into programs to help get them on their feet and onto a better road than they had been. That really made me think haha

Yes they should be. Memory or not, the family affected by a horrendous crime (such as murder) need to begin healing....a conviction is a good place to start.

They probably wouldn't be mentally capable to go to trial if they actually lost their memory and a doctor could prove that they dementia or something like that. But that doesn't mean they couldn't take a plea and still be convicted of their crime and serve time for it which I think they should be fully responsible for, but idk about going to trial.

Yes they should. They committed the crime and should have to face the consequences regardless of memory. Is there a way to actually know if the all the memories were actually gone?
