Should I take him to court?

My baby daddy and I were together for 6 years. We had a beautiful baby girl who is now 1 year and 8 months. However once she turned a year we decided to take a break. Actually I decided I needed a break. Thoughout her whole first year he never paid attention to me. He lied after lie after lie. About 5 months ago we were trying to fix things he'd come over tell me he loved me all that stuff then I found out a month into it he was talking to some girl. I was mad but I'm over it. I met my "better". 
Since he's been with this girl he's completely ignored his daughter. He goes out when it's his week (we agreed on one week him one week me)  he leaves her with his parents and she falls asleep in their bed so He wakes up around 1 and leaves at 230-3 to to go the gym then goes home at 11 from work. Hardly ever sees her. These past 2 weeks I've had her with me in Iowa we're from Texas visiting my boyfriend. 
He's only asked about her 2x and that's because I bitched about him not asking about her. I face timed him (my daughter sat in front of the phone waiting) and he ignored my 3 calls then proceeded to text me I'm with my girl. He never called later. Never asked how she was. 
4-5 days ago she got sick to the point where I had to take her to the drs. I texted him 3x before I called him to let him know I needed her insurance since she's on his I called him 3x then texted him
Again and then called. He turned off his phone. This was at 9am. He has yet to
Ask if she's feeling well or even call! 
I didn't want to take him to court still don't but I feel as if he doesn't care. So my question is should I take him or not?

Take him to court for what? You can't force him to be a dad. Cut your losses and move on. If he wants to be a loser he can do that on his own. If he doesn't want to have interest in his daughter, get sole custody and make him pay child support. Your daughter deserves to be supported even if he's not around.

I think so, yes. Get an agreement in writing, figure out who pays for what, and who gets what holidays. He may not want to be in her life, but he's responsible for financially helping to raise her, and getting something on file with the court means if he decides he's not interested in paying any more, you have a way to protect yourself and your daughter.

If she is on his insurance you should have an insurance card in your possession for your daughter so you don't have to get ahold of him or in case of an emergency when you cant get ahold of him. The other option would be to put her on your insurance so you dont have to worry about going through him. You can take it to court which is probably best thing to do that way its all done and in writing for custody and other things. If he doesnt use his time or take it then that is on him.

This sounds exactly like my situation!!! I could of wrote this LOL I honestly didn't even bother taking him to court, if he doesn't care and doesn't want to be a dad I won't force it upon it. He moved on with his life & I will too. It sucks that the dad won't be around.. But it's so much better than having to fight with him all the time over money, taking care of his daughter etc. I'm doing this on my own and I got this!

I agree with everyone else, take him to court for full custody. But i do have to ask: if you plan on having court mandated child support what makes you think he will actually pay it every month? If he doesnt care about her health, his visitations,  etc. Then what makes you think he will pay up?

Im not trying to be rude, just realistic. What i am getting at is if you are going through this now with just visitations then what are you going to do when he doesnt pay up? You can call/text over and over (based on your story here) he most likely wont answer or respond. You can turn him in for defaulting each month and he can suffer the potential legal action against him or go several thousands of $$ in unpaid support.

But do you really want to go through all of that if/when he doesnt pay up? From personal experience its a major headache and pain in the ass.  Or would you rather get full custody and cut ties with him completely?

Personally i would rather just cut ties completely.  At that point you have tried all you can. You cant force him to be a dad if he doesnt want to. Do what you need to for your daughter. She doesnt need that kind of man in her life. Show her how strong of a mother you can be without depending on her father for assistance.

If he's not paying his dues as a father then yes, take him to court. But first I would let him know that's what you're thinking about doing so maybe he'll step up then.

I honestly don't see why you need to take him to court kinda seems like your tryna being as spiteful as him in that part, move on he obviously has.. However she's your daughter get custody you're her mama you don't need no daddy role she's got you the one that cares the most!
