swaddling

My son is almost 8 weeks. He will be starting daycare in a few days when I go back to work. I live in Texas and it is illegal for them to swaddle in a child care setting. We are trying to transition from swaddling by using his halo sleep sack swaddler and leaving his arms out and swaddling his torso but I have been up pretty much every 15-20 minutes so far and feel as though I might pull my hair out! He has to be exhausted too. Any suggestions to make this transition easier?? I'm about ready to swaddle him so I can sleep!
