Either way ends in divorce....

So I had my husband arrested for domestic violence. He choked me. He served 2 days and has done anger management and AA. We are still awaiting trial. We have however decided to do marriage counseling and work things out. That brings me to my next issue, he was set to receive land from a family member and we was going to build a house. That family member made the remark they didn't want to see that land go to me if things didn't work between us. My husband then decided he needed a pre-nup to insure the land wouldn't go to me. Well we are already married so there is no doing a pre-nup. He then comes up with the idea of doing a divorce just for paper work and no one would have to know and eventually we'd remarry and he could get his pre-nup. However I'm not keen on that idea. He then said I will not persue and future relationship with you if you don't agree. So basically either way ends in divorce. I'm just so lost
