Can a judge order you to return to the child's home state if the mother moved?...for the best interest of the child....fl to ga
Also if they didnt have no type of custody or visitation rights or time sharing establish? Can she move as long as she tells the father where she is going. Then set up for an mediation and lower child support and set up for time sharing. They havent been to court or anything for no custody arrangement or anything.
They have spoke about that plenty of times and he always disagreed for no apparent reason. He would have all breaks and every other holiday. The child is 2

If there is no custody agreement on record with the court, there is no violation by one parent moving. A judge wouldn't order that the parent move back, but very well may give custody and placement to the parent who did not move if it would be in the best interest of the child in terms of stability with school, friends, daycare, etc. So it would be pretty stupid and look really bad to a judge to just up and move without appropriate consideration of the other parent and how they will exercise their ability to spend time with the child. Judges hate that kind of nonsense.

It would have to be apart of a custody agreement that a parent cannot move within a certain distance/miles from a certain address and/or state or a judgment from a judge saying that a parent has to move back (if they already moved) to the home state. If there is no legal agreement, any parent can move where ever they want and it would be up to the parents to make it work as far as visitation with the child.
