Homeschooling question

My husband asked me to post this. His daughter is in 1st grade. And they are not homeschooling her at all. She lives 8 1/2 hours away 1 way in another state so its not like we can make sure she is homeschooled every day. His question is can you get introuble for not homeschooling? They have wifi and all the essentials to do home schooling but choose not too. He is afraid that if the coronavirus don't get better and they don't open the school he's scared that she's going to be super behind.
