Father not seeing child on his weekends

Hi guys, I’m kinda looking for guidance or any advice if anyone has experienced this themselves. My daughters father legally has every other weekend. He has not exercised his weekend since the last weekend of May. I’m getting the run around kinda on when he’ll be back in the state for these past months. She starts kindergarten this upcoming year and I’m looking for consistency for her sake. I’ve offered FaceTime for him he’s done it 3 times since May. At this point idk why he should legally have every other weekend if it’s just a suggestion to him. If I shouldn’t expect him to see her why should he legally have that time? Is it justified to go court to have this time adjusted? I’m more than willing to let him visit when he comes back but I have no info on when he’s back , how long he’ll be back , etc. it’s a custodial agreement so if you break it are you not going against court orders?
