Car accident lawsuit

Over the weekend my family and I were hit by a drunk driver. I'm currently 30 almost 31 weeks pregnant, and my 3 year old and 11 year old daughters and husband were also in the car. If we weren't in the vehicle we were in my 3 year old would be dead (by the way the door caved in she should have had serious injuries) None of us were hurt, my back and my husbands neck are a little messed up, and my 11year old has bruised ribs... We are seeking legal council against the guy that hit us but I still feel wonky about suing anyone, it's not my thing. I definately need therapy, I have horrible panic attacks even thinking about needing to get the car... I guess my question is needing opinions on how you guys feel about lawsuits for these reasons. Am I justified?
