Do I have to abide by the hospital - stay rules?

Question

If I wanted to leave earlier than the hospital wanted me to stay after I give birth (provided there were no complications)  , could I?
And would there be any consequences ?

You can sign an AMA (against medical advice) meaning you are being asked by your physicians to stay at the hospital and you understand that leaving the hospital prior to their approval can result in you becoming sick/dying or even your child. They can not keep you against your will but signing an AMA has some consequences.

1) if something was to happen to you or your child then that is on you. Legally.

2) some/most health insurance won't cover your medical bills if you sign out AMA.

3) IF something were to happen to you or your child as a consequence of you leaving early and against medical advice then your insurance can again refuse to pay your medical bills for the return visit as well as refusing the prior hospital stay.

Hope that helps. You can always ask your OB about an early discharge. After I gave birth my OB was ok with me leaving and offered to let me leave after 24 hrs but my baby wasn't eating as well as I would like so I asked to stay.

My doctor said that I could leave whenever I wanted but they have to keep the baby 24 hours. I ended up staying 2 days because there is nothing like the help you get in the hospital

My doctor willingly discharged me early after a c section because my daughter had been life flighted to another hospital.. She knew I wasn't going to stay if she didn't. I was doing well and there was no major reason to keep me. Oh btw my nurse woke my doctor up at home at 2am to get the discharge orders! As a nurse I definitely would not suggest leaving AMA. It's not worth the possible consequences.

If the doctors think you or you and the baby should be there longer regardless the circumstances you should stay 1 as someone said there's no help like the hospital you'll have everything you really need and 2 they are trained professionals and if they think there is a possibility of a problem with either of you who are you to argue with them.. Just saying it sounds dumb for anyone to leave outside of a doctors orders it's better safe than sorry

We told them after 5 days of being there that we were going to leave that day. They said they wanted me to stay another day and we refused (the reason they wanted me to stay was because I had severe preeclampsia causing me to have a c section early my blood pressure was super high. But they had already monitored me for 3 days and although my blood pressure went down slightly they wanted to keep monitoring it. However the day shift nurses and doctors were a joke and I was just getting upset with them) we told them that my blood pressure was not going to go down there and we wanted to go. All they said was they wanted to try some other medicine and draw blood 2 hours later. Had I not agreed to that I would have had to sign papers saying I understand the risk of leaving against doctor recommendations. I did what they asked and we were able to leave without signing anything

So the doctors/hospital isn't legally responsible for anything that happens to you after you leave.

I've always told the doctor that I want to go home as soon as I can and they usually let me leave as soon as medically cleared without any problems.
