i'm 16 and i was at this party and i was pretty drunk. Well the next day i woke up at this guys house with my friend (girl) it was us two and 4 guys. turns out this guy i liked (18) had apparently slept with me because i was wearing his shorts and my underwear was in his truck. does it count as rape since i had already had feelings for him and wanted to have sex with him. The only difference is that he is saying we had sex and i don't remember it at all so how do i know if i said yes or no   I mean i don't remember much from that night so how do i know if he wasn't just saying that?

I don't think so. If u can't recall anything I don't even know how to start with that. U can call it rape all u want but at this point it's all hearsay unfortunately. U don't know if u consented or not. The mere fact I flat out said u don't remember much about that night puts me on the fence. Maybe talk to ur friend see if she remembers anything. When ur intoxicated true feelings come out. If u had those feeling prior u really don't know who jumped who's bones. Honestly it wouldn't hold up in court and if u have feelings for the guy maybe talk to him about it and Make it clear next time ur intoxicated not to do anything.i had a similar experience however I had already slept with the guy prior to the black out drunken experience only difference I woke up next to my best friend whom was also naked. None of us had any idea what happened that night outside of the ppl who stayed sober. Turns out I had a 3some. Technically according to what everyone else is posting they would consider that rape. Me, no..I knew I wanted him b4 I got fucked up it just sucks I can't remember it

Probably not the best idea to Come on here where everyone is going to say it's rape based off their emotions and NO knowledge of the ENTIRE situation. PLEASE PLEASE PLEASE do not take any day action tool u get 100% of the facts straight. As I said b4 ask your friend if she remembers anything first she will probably be the best one to give any advice. As u stated u said u were drunk and had already had feeling for the guy. It really makes me question who initiated it. I know since u were drunk and aren't of sound mind to give consent however, with out any FACTS you cannot press charges. U would make a fool of everyone involved because there are no facts to prove  uu were IN FACT raped. Now u can go for the statutory rape chares  if u feel that's what u need to do. But again  because u did say that u already had those intentions/feelingsth keep in mind a jury might not see it as anything outside of statutory  rape. (Which doesn't matter If u conestented or not that's an age thing) please take into consideration prior conversations  , prior actions u initiated, things u could have said b4 hand in refer wince to being intimate ha with him. Please don't just come on here because ur confused and make a decision involving someone else life based off of people opinions who know nothing about the situation

As Someone who went through the same thing I can tell you it was rape.  No matter how much yu wanted it if you can't remember then in the moment you certainly weren't conscious enough to say yes or no.  He took advantage of you and I would take a plan b pill just in case he didn't use protection.  If you need someone.
