Being sued for hitting drunk jaywalker. Please read first

So here’s the story.

A man is drunk, wearing all black, wandering in the middle of a back county road at night, and gets hit by a car and sadly passes.

Police find the driver totally innocent and the death accident and don’t charge him with anything.

The family of the victim then sues the driver for a significant amount of money and wins.

Do you think it’s wrong the the driver lost?
