Do I need a lawyer?

So I plan on leaving my bf, we have two kids together (2.5 year old and a 6 month old) 
Well for the pass couple of months Boyfriend “the dad” been mistreating my babies and I’m sick of it, they’re to small to be yell at no reason and always hitting my 2.5 year old and always calling them bad names.
-drug come first to him 
 -he’s on the birth certificates so that mean he can take them from me (he say) 
    
So my question is do I need a lawyer for (bf) to sign his right over? 
Does a lawyer need to be present when he does sign? 
..He always told me if I try to leave with my kids, he’ll kill me or plant drugs on me...... 
I just want me and my kids Safe!!

Save everything he’s texted you and wrote down every threat he makes. Then go to a lawyer to discuss your options. You definitely need to speak to one

In most states since youre not legally married you the mother would have automatic custody. He can petition the court for visitation/shared custody but if he a junkie that probably wont happen. The most imporatant thing you can do before or while leaving is gather evidence in case he does try for custody. Download a voice recorder so you can record his threats, take pics and videos if its safe to do and save any threatening messages.

Wow. Okay so first of all: your kids aren’t safe. They are being abused and potentially out in unsafe situations due to his drug use. 
So that means CPS (child protection services) could intervene if they received knowledge of this situation. 
So what you need to do (and actually have a duty to do) is to keep the kids safe. It is going to look good to any judge, lawyer, or child protection agency if you remove the children from harms way (meaning: get those kids away from their dad).  
So not only does your SO have not a single leg to stand on, but you actually have a duty to get those kids out of there. 
If he ever tried to take the kids away from you, you’d just call CPS yourself and report that the kids aren’t safe. 
So first things first: you and the kids need to leave. And don’t trust him to ever be alone around the kids. 
Then once you’ve left, if he wants to see the kids then he can hire his own lawyer and take you to court to see them (and since that costs money and he’s on drugs, he probably won’t want to spend the money on a lawyer):

Yes! Get an attorney and an advocate from the court to assist with protection. Are his threats in writing?

You need to save everything and gather up as much evidence as you can. Unless he agrees to sign his rights away you can’t just make him I don’t think. Lawyers give free consultations. Once you have enough evidence go to the lawyer and then the police. ￼
