Can I divorce without a job yet??

I recently left my husband due to domestic violence, He got evicted from the home also over this. He took everything from my son and I, all of our things , child bed and furniture were outside and got rained on /damaged ,stolen, We are now with my mom. I have been searching for a job but haven’t gotten hired yet, I was a SAHM, & didn’t get approved for childcare assistance bc I have to have a job. I want to divorce him asap but i’m afraid I won’t get full custody with no job and may need to wait. He said he will agree to a uncontested divorce and custody if I do no alimony, if I file& pay, but if I wait he may change his mind. I want out of this now because I feel if I wait I won’t be able to find him. He has a mistress and took me off of all of the accounts and put her on (I got an email notification for proof) , He doesn’t want our child but I fear he will fight to get out of child support. Also I have proof of everything , plus police reports, and he’s been to court over the situation. Also landlord and neighbors a witness to him putting me & his child out then changing the locks , throwing out our stuff before he got removed from the home. Married 5 years
