He is technically married man

Is it okay to be intimate with a new partner? He is separated and going through the divorce process. We have met on dates and spend so much time talking but officially he is married. He said his married has been dead for a long time and nationally detached from his ex (wife).

Please advise.

P.S: yes I have seen proof of process and both man and ex wife have filled conditional order.
