Scenario Updated

This morning I posted a scenario about a woman going out to a bar, getting drunk, and begging a man to hook up with her. He took her home and they had sex. The morning after she wakes up with no memory and accuses the man of rape. I deleted the last post because so many people were not clear. After much debate I realized I didn't put in enough information.

UPDATE:

He drank just as much as the woman. The man protested taking her home several times before he did. They both agreed during sex and no one was harmed. They fell asleep. And she woke up with no memory because of the amount she drank. However the man did have memory and knew she consented. She said he raped her, police were called and he was taken into custody because of her accusations.

Now. Who is the person to blame?
